An Unlawful Detainer Assistant is any individual who for compensation renders assistance or advice in the prosecution or defense of an unlawful detainer claim or action, including any bankruptcy petition that may affect the unlawful detainer claim or action.
Unlawful detainer assistant shall file a certificate of registration with the county clerk of the county in which he or she resides or has his or her principal place of business.
To register as an Unlawful Detainer Assistant in San Mateo County, please complete and provide the following: (if renewing, information below):
- A completed registration form
- An unlawful detainer assistant bond. The bond must show date of issuance and date of expiration. The recorded bond will be returned by mail within 6 to 8 weeks.
- Unlawful Detainer Assistant registration fee
- Applicants must physically present a valid government-issued photo ID.
Renewal Information
(B&P Code Section 6402.2, 6406 & 6407)
To be eligible to renew registration, the registrant shall complete 15 hours of continuing legal education courses during the two-year period preceding renewal.
The Unlawful Detainer Assistant registration is effective for a period of two years, or the bond expiration date, whichever occurs first. The renewal can take place up to 60 days prior to the expiration date; the effective date of the renewal will be the date your current registration expires. As long as the renewal takes place on or before the expiration date, the registration number will remain the same. The above-listed requirements (including fees) still apply when renewing.
