If documents are submitted without appropriate exemptions, filing fees will apply and will be charged accordingly. The submitted document will not be accepted for filing unless the required filing fees are paid.

In order to be exempt from paying the filing fees, either of the following (whichever applies) must be attached to the appropriate Notice of Determination (NOD) upon filing (in accordance with Cal. Code Regs., Tit. 14, § 753.5 [e][4]):

  • Photocopies of all previously paid environmental document filing fee receipts; or
  • Notice of Exemption; or
  • No Effect Determination

Annual Fee Adjustments

CDFW is required to adjust the fees annually (Fish & G. Code, § 713). The annual fee adjustments are based on changes in the Implicit Price Deflator for State and Local Government Purchases of Goods and Services, as published by the U.S. Department of Commerce. Annual filing fee adjustments are posted on CDFW’s website prior to November 1 of the year before they become effective.
